NOTICE
OF ADMIRALTY ACTION AND ARREST IN REM
PLEASE TAKE NOTICE that on August 4, 2000 at 4:30 p.m., the Honorable George A. O’Toole, United States District Judge for the District of Massachusetts at Boston, MA caused to be issued through the Clerk’s office a Warrant of Arrest In Rem against The Wrecked And Abandoned Steam Vessel R.M.S. REPUBLIC, her tackle, appurtenances, apparel, cargo, etc. at the above stated coordinates pursuant to Plaintiff Martha’s Vineyard Scuba Headquarters Inc.’s request for relief set forth in its Complaint filed on this same date with the Court. At the conclusion of the 2000 salvage season, the Plaintiff shall petition the Court (a) to consolidate the above entitled action with its prior action, Case No. 82-3742-S, filed previously in this Court regarding the Defendant Vessel, (b) to award title to the RMS REPUBLIC and its contents, etc. to Plaintiff as rightful finder of the Defendant Vessel, (c) to have its claim of exclusive salvage rights continued and (d) to adjudicate title to Martha’s Vineyard Scuba Headquarters Inc. of any objects, artifacts, cargoes, etc. recovered from the Defendant Vessel and within the area of the aforesaid coordinates.
Any party having a legally cognizable claim or interest in the Defendant Vessel and her contents or the objects recovered by Plaintiff is hereby placed on notice of the within action and admiralty arrest of Defendant Vessel and such party must file their claim in the United States District Court, One Courthouse Way, Boston, Massachusetts 02210 within ten (days) after publication of the within Notice or execution of service thereof, and thereafter a responsive pleading to the Plaintiff’s Complaint shall be filed herein within twenty (20) days following such claim or thirty (30) days after service, whichever is less. The failure to do so shall result in the termination and/or extinguishment of such claim or interest with prejudice.
